According to the Nebraska State Patrol, Dennis Hall was found deceased outside a Lincoln Town Car with a flat tire parked on the shoulder of the highway. Preliminary investigations reveal that Hall was attempting to change the flat tire when he was struck by a passing vehicle. Witnesses reported seeing a vehicle leave the scene, and evidence indicates that the vehicle involved was a semi-truck, likely with damage on the front passenger side.

Fatal Semi-Truck Accidents on Nebraska Roadways

Semi-truck accidents have become a growing concern on Nebraska’s highways, with a noticeable increase in fatal incidents over recent years. According to data from the Nebraska Department of Transportation, there were 135 fatal crashes involving large trucks in 2023, marking a 12% rise from the previous year.

This increase highlights the ongoing dangers associated with heavy vehicles on the state’s roadways. Factors contributing to these accidents include driver fatigue, poor road conditions, and mechanical failures. The severity of these crashes often results in tragic outcomes, making highway safety a critical issue for Nebraskans.

Furthermore, the Federal Motor Carrier Safety Administration (FMCSA) reports that semi-truck accidents account for approximately 11% of all traffic fatalities nationwide. The substantial size and weight of these trucks significantly increase the risk of severe injuries and fatalities in collisions. As the volume of freight transport grows, ensuring rigorous safety standards and effective enforcement becomes essential in mitigating these risks.

In the unfortunate event of a fatal semi-truck accident, the affected families may seek legal recourse through a wrongful death claim. In Nebraska, such claims can be filed by the deceased’s representative, who is usually a family member or an appointed individual. This claim is pursued on behalf of the surviving family members, including spouses, children, or other dependents.

The purpose of a wrongful death claim is to seek compensation for the financial and emotional losses suffered due to the death, including support, companionship, and funeral expenses. It is crucial to initiate this legal process promptly, as Nebraska law generally allows two years from the date of death to file a claim.

Seeking legal guidance is essential for victims and their families to navigate the complex legal process and pursue rightful compensation.
